Dealing with major issues in Jewish biomedical law, this book focuses upon the influence of morality, the rise of patient autonomy, and the role played by scientific progress in this area of Jewish Law. The book examines Jewish Law in comparison with canon, common, and modern Israeli law.

The main theme of the article is the tension between the obligation to preserve life, and the value of timely death. This tension is resolved by distinguishing between precipitating death, which is prohibited, and merely removing an impediment to it, which is permitted. In contemporary Jewish law, a distinction is made between therapy, which may be discontinued, and life-support, which must be maintained until the establishment of death. Another theme is that of “soft” patient autonomy, and its role in dealing (...) with the dying in both traditional Jewish law and Israel’s Terminal Patient Law, 2005. There are several key differences between the codes of ethics developed by the American Psychological Association and the Canadian Psychological Association. This paper tells the story behind the key differences between the U.S. and Canada codes. It starts with an introduction to the two countries and a brief history of what led up to the American Psychological Association’s (APA) decision to develop the world’s first ethics code for psychologists. This is followed by a description of the development process used by (...) APA, and the reasons why the Canadian Psychological Association (CPA) originally adopted the APA code but subsequently chose to develop its own “made-in-Canada” code of ethics. The key differences of the CPA code, the cultural, legal, and philosophical contexts that help explain the rationale for those differences, and why the differences have been maintained are discussed. In particular, attention is given to the CPA code’s strong focus on: (a) the concept of a contract with society; (b) aspiration vs. enforcement; (c) ethical reasoning and decision making; and (d) organizing standards around ethical principles. The interaction between cavity modes and optical transitions leads to new coupled light-matter states in which the energy is periodically exchanged between the matter states and the optical mode. Here we present experimental evidence of optical strong coupling between modes of individual sub-wavelength metamaterial nanocavities and engineered optical transitions in semiconductor heterostructures. We show that this behaviour is generic by extending the results from the mid-infrared to the near-infrared. Using mid-infrared structures, we demonstrate that the light-matter coupling occurs at the (...) single resonator level and with extremely small interaction volumes. We calculate a mode volume of 4.9 × 10 from which we infer that only ~2,400 electrons per resonator participate in this energy exchange process. (shrink)

This paper argues that two single-factor accounts of exploitation are inadequate and instead defends a two-factor account. Purely distributive accounts of exploitation, which equate exploitation with unfair transaction, make exploitation pervasive and cannot deliver the intuition that exploiters are blameworthy. Recent, non-distributive alternatives, which make unfairness unnecessary for exploitation, largely avoid these problems, but their arguments for the non-necessity of unfairness are unconvincing. This paper defends a two factor account according to which A exploits B iff A gains unfairly from (...) B and either A believes that the gains he receives in the transaction wrong B, or A is culpably unaware that the gains he receives in the transaction wrong B. This account avoids the problems of non-distributive approaches and also delivers the intuition that exploiters are blameworthy. (shrink)

Markosian presents an argument against certain theories of time based on the aesthetic value of music. He argues that turning a piece of music sideways in time destroys its intrinsic value, which would not be possible if the Spacetime Thesis were true. In this paper I show that sideways music poses no problems for any theory of time by demonstrating that turning a piece of music sideways does not affect its intrinsic value. I do this by appealing to spatial analogies (...) that highlight the similarities between spatial and temporal rotations. (shrink)

We examine the relationship between the logics of nonsense of Bochvar and Halldén and the containment logics in the neighborhood of William Parry’s A I. We detail two strategies for manufacturing containment logics from nonsense logics—taking either connexive and paraconsistent fragments of such systems—and show how systems determined by these techniques have appeared as Frederick Johnson’s R C and Carlos Oller’s A L. In particular, we prove that Johnson’s system is precisely the intersection of Bochvar’s B 3 and Graham Priest’s (...) non-symmetrized connexive logic and that Oller’s system lies just beneath the intersection of B 3 and Priest’s paraconsistent L P. We conclude by examining Oller’s system in more depth, giving it a characterization in terms of L P and showing that it plays the same role to Harry Deutsch’s paraconsistent containment logic S that Aleksandr Zinov'ev’s S 1 plays with respect to A I. Abstract:AbstractIn the post-Trayvon Martin era of racial terror against Black people in the U.S., many scholars frame contemporary anti-Black racial violence in the U.S. as an injustice primarily experienced by Black men and boys. This framing, however, fails to capture the deeply entrenched reality of Black violability. Black violability encapsulates the lived and historical experiences of Black people with state-initiated and state-sanctioned violence. This essay argues for a herstorical approach, which renders visible Black women and girls, trans*, genderqueer, and queer (...) people as victims of anti-Black racial terror. (shrink)

Using the Universal Declaration of Ethical Principles for Psychologists as an ethical framework, some of the major successes, challenges and needs that psychology has regarding its responsibilities to society in the area of end-of-life decision making and active euthanasia are outlined in this paper. Four particular responsibilities are highlighted: (a) increase professional and scientific knowledge; (b) use psychological knowledge for beneficial purposes; (c) adequately train its members: and (d) encourage beneficial social structures and policies. For each responsibility, some of the (...) major societal-level ethical issues and current needs discussed in the literature are identified, as well as ways that psychology has contributed to dealing with those issues and needs. In conclusion, several recommendations are offered regarding ways in which psychologists and psychology could increase its contribution. (shrink)

In this paper, we consider some contributions to the model theory of the logic of formal inconsistency $\mathsf{QmbC}$ as a reply to Walter Carnielli, Marcelo Coniglio, Rodrigo Podiacki and Tarcísio Rodrigues’ call for a ‘wider model theory.’ This call demands that we align the practices and techniques of model theory for logics of formal inconsistency as closely as possible with those employed in classical model theory. The key result is a proof that the Keisler–Shelah isomorphism theorem holds for $\mathsf{QmbC}$, i.e. (...) that the strong elementary equivalence of two $\mathsf{QmbC}$ models $\mathfrak{A}$ and $\mathfrak{B}$ is equivalent to them having strongly isomorphic ultrapowers. As intermediate steps, we introduce some notions of model-theoretic equivalence between $\mathsf{QmbC}$ models, explicitly prove Łoś’ theorem and introduce a useful technique of model-theoretic ‘atomization’ in which the satisfaction sets of non-deterministically evaluated formulae are associated with new predicates. Finally, we consider some of the extensions of $\mathsf{QmbC}$, explicitly showing that Keisler–Shelah holds for $\mathsf{QCi}$ and suggesting that it holds of extensions like $\mathsf{QCila}$ and $\mathsf{QCia}$ as well. In ‘The Authorship of Sister Peg', David Raynor relies on circumstantial evidence, unsubstantiated hypotheses, and subjective analysis in an effort to dispute my article ‘Let Margaret Sleep' and claim the authorship of Sister Peg for David Hume. This reply focusses instead on the large body of documentary and testimonial evidence that has surfaced during the past forty years, which overwhelmingly and convincingly supports the attribution of Sister Peg to Adam Ferguson. New documentary evidence includes Ferguson's emendations in Sir (...) Walter Scott's copy of Sister Peg, an 1809 letter from Ferguson to Alexander Fraser Tytler and Tytler's response to it, and information about the early publishing history of the work – as well as a letter by Hume himself about his preoccupation with another project when Sister Peg was written. While no new contemporary testimonials alleging Hume's authorship have been discovered since the publication of Raynor's edition of Sister Peg in 1982, at least nine contemporary testimonials naming Ferguson as the author are now known. This reply refutes Raynor's attempts to discredit the most famous of these testimonials – the account of Ferguson's authorship in the memoirs of Alexander Carlyle – and shows that the others cannot be reduced to Carlyle’s influence. Peirce made repeated attempts to clarify what he understood as abduction or creative reasoning in scientific discoveries. In this article, we draw on past and recent scholarship on Peirce’s later accounts of abduction to put a case for how teachers can apply his ideas productively to elicit and guide student creative reasoning in the science classroom. We focus on (a) his rationale for abduction, (b) conditions he recognised as necessary to support this speculative reasoning, (c) pragmatic strategies to guide inquiry (...) and test conjectural hypotheses, and (d) his growing recognition of creative dimensions to reasoning beyond abductive inference-making. We illustrate this case through examples of a guided inquiry approach to student claim-making in the science classroom. (shrink)

Barbara Herman offers an interpretation of Kant's Groundwork on which an action has moral worth if the primary motive for the action is the motive of duty. She offers this approach in place of Richard Henson's sufficiency-based interpretation, according to which an action has moral worth when the motive of duty is sufficient by itself to generate the action. Noa Latham criticizes Herman's account and argues that we cannot make sense of the position that an agent can hold multiple motives (...) for action and yet be motivated by only one of them, concluding that we must accept a face-value interpretation of the Groundwork where morally worthy actions obtain only when the agent's sole motive is the motive of duty. This paper has two goals, one broad and one more constrained. The broader objective is to argue that interpretations of moral worth, as it is presented in the Groundwork, depend on interpretations of Kant's theory of freedom. I show that whether we can make sense of the inclusion of nonmoral motives in morally worthy actions depends on whether the 'always causal framework' is consistent with Kant's theory of freedom. The narrow goal is to show that if we adopt an 'always causal' framework for moral motivation, then Herman's position and her critique of the sufficiency-based approach fail. Furthermore, within this framework I will specify a criterion for judging whether an action is determined by the motive of duty, even in the presence of nonmoral motives. Thus, I argue Latham's conclusion that we must accept a face-value interpretation is incorrect. (shrink)

I argue that Quine’s naturalization of Lewis’s Kantian pragmatism should be understood in terms of Lewis’s attempt to de-psychologize pragmatist epistemology. Lewis wants epistemology to be a priori in order to be distinct from psychology. Quine’s criticisms of Lewis result in a picture that weakens the distinction between epistemology and psychology. Nevertheless, Quine’s naturalized Kantian pragmatism remains far more Kantian than is widely recognized, due to what Quine retains from Lewis.

Nearly four decades after David Raynor attributed to David Hume an allegorical Scots militia pamphlet from the early 1760s popularly known as Sister Peg, there is still no scholarly consensus about whether the author was in fact Hume or his friend Adam Ferguson. Using new evidence that has emerged since the appearance of Raynor’s edition in 1982 – including information about Sister Peg’s publication history, Ferguson’s handwritten corrections and revisions in the Abbotsford copy of the work, a 1767 (...) newspaper article by James Boswell and a copy of a 1775 letter by Sir John Dalrymple that both named Ferguson as the author, two volumes of Ferguson’s correspondence published in 1995, and a recently discovered letter by Ferguson from 1809 – this article seeks to resolve this controversy by establishing that Sister Peg was written by Ferguson, as his fellow militia agitator Alexander Carlyle asserted in his memoirs. In the process, the article refutes Raynor’s arguments about Ferguson’s supposed incapacity for writing a satirical pamphlet like Sister Peg and clarifies the nature of Hume’s views and actions in regard to the Scots militia cause during the Seven Years’ War. The article also throws light on several related issues affecting Hume and Ferguson’s circle. (shrink)

In this thesis I present a rights-based theory of exploitation. I argue that successful conceptions of exploitation should begin with the ordinary language claim that exploitation involves `taking unfair advantage'. Consequently, they must combine an account of what it means to take advantage of another with an account of when transactions are unfair. Existing conceptions of exploitation fail to provide adequate accounts of both aspects of exploitation. -/- Hillel Steiner and John Roemer provide convincing accounts of the unfairness involved in (...) exploitation, but because they fail to provide restrictive `advantage taking' conditions, their theories of exploitation include cases that we would not ordinarily describe as exploitations. Ruth Sample and Robert Goodin provide accounts that place a stronger emphasis on the attitudes involved in exploitation and the processes that bring it about. Unfortunately, these theories do not properly incorporate the unfairness aspect of exploitation. Consequently, they are either self-frustrating or incomplete. -/- I provide a conception of exploitation that combines both aspects. I claim that a bilateral, strictly Pareto improving, and voluntary transaction t between A and B is exploitative just in case (1) there exists an unrectified property rights violation at some point in the history of exchanges leading to t that (2) reduces B's bargaining power by altering her status quo point, and (3) the degree to which B's preferences are satisfied in t is less than it would be had B's bargaining power not been reduced (by the alteration of her status quo point). Further, (4a) A's egoistic preferences are better satisfied in t because B's bargaining power is limited, and (4b) if the previous conditions also hold for A, then the reduction in A's bargaining power is less than the reduction in B's bargaining power.
